ORDERING & SALE TERMS and CONDITIONS

CONDITION OF SALE
All sales are final and all products sold by Sales(AT)a1customs.com and/or Jim Ben Young, hereinafter referred to as “Seller”, are sold "as-is" to Buyer.

ACKNOWLEDGEMENT AND ACCEPTANCE
All orders placed with the seller (email, mail, phone, fax and in person) constitutes the acknowledgement and acceptance of any and all of Seller’s terms and conditions.

RETURNS
Authorization to return product must be obtained from Seller in advance and must be made within 5 (five) days of purchase. Any returns, exchanges or cancelled orders will be subject to a 25% (twenty five percent) restocking fee. Any products which are approved for return are for store credit only. All product returned must be in the same condition as it was originally delivered by Seller to Buyer otherwise no refund will be given. Special or custom made orders or limited production items are NOT refundable.  Any electrical or mechanical parts are also NON returnable. Merchandise signed for or left as delivered by carrier are assumed delivered and no shortage claims will be considered unless noted on delivery ticket at time of delivery. Damaged-shipped merchandise must claim with the freight carrier. Original receipt must be presented for credit or exchange. NO RECEIPT NO REFUND. All returns must be sent to Seller freight prepaid and insured by Buyer. No refund or credit on labor or freight charges. Any refused shipment sent back to Seller does not constitute the right to any refund credit. Seller will keep any and all deposits or payments for any merchandise that is not picked up after 30 days from the original order date and then deem order to be null and void. Buyer is responsible to pay for any and all taxes and duties.

LEGAL
 It is understood and agreed that any possible legal matter arising from the website or orders from the website or via email will be held in the venue and at a location of this webmaster’s or Seller’s choosing and at your expense including any legal fees this also includes but is not limited to; trying to recover funds due, not paid or charged-back; bad checks, bounced or insufficient funds check fees, stopped payments, COD refusal, order or delivery refusal, shipping costs, and fraud etc. In addition collection agencies or other services or reporting to credit bureaus may used and will be given any information Seller has or can get so any funds, costs or damages due Seller can be recovered. Any attempt by buyer to circumvent Seller’s terms and conditions and agreement by filing for a credit card charge-back or other means will be construed as an attempt to defraud and will be handled as such, by buyer placing an order with Seller via any means, Buyer acknowledges and agrees to and accepts to be bound by all the Seller’s terms and conditions.

SPECIAL ORDERS
 All special orders must be pre-paid in full and funds must clear before we will ship merchandise, if the Buyer attempts to cancel the order for any reason, the Buyer understands that the deposit or prepayment is forfeited immediately to Seller. Custom made, special order or limited production items must be paid in full at the time of ordering and are NON-refundable. Most of the Seller’s products are limited production, special order and/or custom-made and are NON-cancelable, NON-returnable and NON-refundable. 

CORE RETURNS
 All core returns must be made within 30 days from the original invoice date. NO EXCEPTIONS. All core returns are subject to approval and must be accompanied by a copy of the original invoice.

ORDERING
 Most of the Seller’s products are limited production, special order and/or custom-made and are NON-cancelable, NON-returnable and NON-refundable.  Should any product be undeliverable for any reason by wrong address or refusal or returned the order will be held by Seller for 30 days in which Buyer will be allowed to contact Seller to pay to have the item(s) reshipped to Buyer, at Buyer’s expense, should Buyer not do so the item(s) will be considered forfeited. In such a situation we would try to contact Buyer, using contact info provided by Buyer at time of order, it is the Buyer’s responsibility to have provided Seller with valid phone numbers and email addresses.

 Buyer agrees to order these items withOUT any intent to; copy, reproduce, resell, relabel, sell for profit or reverse engineer, compete with, slander, libel, defame bad mouth, defraud or to aid anyone with intent to do such. Buyer is hereby informed that most of these items are the Seller’s designs and will be protected and violators should expect civil damages to be sought, and criminal matters to be prosecuted to the fullest extent of the law.

CONTINGENCIES
 Seller shall not be liable for any failures to produce product to buyer when the cause of such failure is an act of God, Labor Dispute, supplies of material shortage; acts of local state, national, civil, or other authorities or public agencies; utility or communication failures, accidents, strikes, transportation problems, or any act or cause that does not normally occur in the ordinary course of Seller's business.

PERFORMANCE PRODUCTS
 Seller does engage in selling aftermarket items and buyer does understand the ramifications for having these performance or aftermarket parts on a vehicle. Seller is not held accountable for any misconception or disappointments associated with any of these parts. Some products can adjust and/or increase power levels beyond factory parameters, so their use could possibly void your warranty, and may not be legal for use on emission controlled vehicles in some areas, any products including all engine, exhaust, performance, and modification parts are legal in the state of California for off-road use only.
Due to these facts Buyer accepts all responsibility for use, and his/her actions, there is NO warranty either expressed or implied as to use of products. Improper installation, settings and/or use of such could possibly cause property damage and or personal injury. Buyer agrees and understands that he/she should possess a basic mechanical and automotive knowledge to install any parts and if not should seek out a professional to do any installation. 

 The Magnus-Moss Warranty Act prohibits a dealer or manufacturer from voiding your vehicle warranty unless a product is directly responsible for a failure. 

Products pictured on website may differ slightly than those delivered; components supplied by vendors, or the vendors used  may change, functionality should not be effected, as we improve the products slight changes are usually necessary.  We reserve the right to change products as we see fit without notice. Prices subject to change without notice.

WARRANTY
 Unless seller states in writing otherwise, most of Seller’s products or parts contain electronic components and therefore are non-returnable (as is common automotive industry standard) and hold little or no warranty. Products are thoroughly inspected and tested and orders are triple checked for accuracy prior to shipping . Should Seller determine any defect to exist or arise, product will be repaired or replaced at Seller’s determination.  If Buyer feels the need to return an item, Buyer must call for a RGA (return goods authorization) number otherwise the shipment will not be accepted.  Any returns Seller does accept that are not from a defect or error on Seller’s part will be charged a 25% restocking charge, NO credit will be given on product damaged once delivered to the Buyer. Seller reserves the right to make final judgment in IF any refund will be made or not. Orders are shipped insured and Shipping Service is responsible for any possible transit damage.
 Seller will not be held liable for any damages which are incurred directly or indirectly on the vehicles or operators or passengers of the vehicle.

PAYMENT
Payments MUST be made in US Dollars. Seller will not be responsible for exchange rates and orders will not be shipped if underpaid and will not responsible to refund if exchange is overpaid, it is the buyer’s responsibility to get us the correct amount in US Dollars to the Seller.  Seller will accept; personal, business, cashier’s checks and money orders however Seller’s policy is that goods will NOT ship until funds clear, Money Orders DO take time to clear, sometimes as much as 5 days or more.
 ONLY the United States POST OFFICE Money Orders process fast and these are the preferred method if you want your order fast. 
 If Buyer wants to pay by credit, debit, ATM or check  card, Seller is PayPal VERIFIED and Buyer can pay via that service www.paypal.com Buyer must ADD 5% to the order total if using PayPal. We do NOT accept PayPal payments unless the buyer's PayPal account is "VERIFIED" and address "CONFIRMED". PayPal is often a fast way for a Buyer to order get their order processed, PROVIDED their PayPal account is "VERIFIED" and address "CONFIRMED" however sometime the approval can take a few day, also some Paypal payments can take up to a week or more to clear, so it is advisable for persons interested in using this service to order products in the future to sign up there now, when doing so, in the referred by spot put " [email protected] "

 The next best and almost foolproof option for FASTEST payment is the United States POST OFFICE Money Orders sent to Seller via Priority Mail, Express Mail or other faster or overnight service.

Seller reserves the right to limit or specify how Buyer must pay.

Seller reserves the right to refuse payment and/or service to anyone.

Furthermore it is understood and agreed that any possible legal matter arising from the website or orders from the website or via email will be held in the venue and at a location of this webmaster’s choosing and at your expense including any legal fees and you thereby waive any rights you may have had otherwise, this also includes but is not limited to; trying to recover funds due, not paid or charged-back; bad checks, stopped payments, COD refusal, taxes/duties due, order or delivery refusal, shipping costs, and fraud etc.

RUSH ORDER SERVICE
"RUSH" order service does NOT include shipping costs, but is a priority service where those orders are given special attention and bypass Seller’s regular schedules, in most cases a special trip to the shipping carrier's depot is made to get those orders out faster. RUSH order service typically is only $20 in addition to shipping, handling and insurance costs.

SHIPPING
Buyer agrees that Seller will choose freight carrier. Buyer is responsible for all duties and taxes that may apply to their order be it now or in the future. Seller shall not be liable for late, lost or misdirected shipments. All shipping dates are approximate. Buyer shall not be entitled to chargebacks, reductions in price or other offsets as a result of late shipment or failure to deliver in estimated time of delivery.  Merchandise signed for or left as delivered by carriers are assumed delivered and NO shortage claims will be considered unless noted on delivery ticket at time of delivery. Damaged-shipped merchandise must claim with the freight carrier. Second Day or Next Day shipping or out of the 48 continental United States is substantially more than standard “ground” shipping.
